Welcome to Seazond. The terms “we”, “us” and “our” refer to Seazond. Seazond operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Seazond is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.

Please read these Terms carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use or access our Services.

We make reasonable efforts to display our products and services accurately. However, colors and product appearance may differ from how they appear on your screen due to device type, settings, and configuration.

We do not warrant that the appearance or quality of any products or services purchased by you will meet your expectations or be exactly as depicted in our online store.

All descriptions of products and pricing are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit quantities offered to any person, household, geographic region, or jurisdiction.

SECTION 3 - ORDERS; ORDER ACCEPTANCE; CANCELLATIONS

When you place an order, you are making an offer to purchase. We reserve the right to accept, decline, limit, or cancel your order for any reason at our discretion to the fullest extent permitted by law.

Your order is not accepted until we confirm acceptance. We must receive and process your payment before an order is accepted.

Please review your order carefully before submitting. We may be unable to accommodate cancellation or modification requests after an order is accepted, including after fulfillment or shipping has begun.

In the event we cancel or make changes to an order, we will attempt to notify you using the contact details provided at checkout.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export unless expressly authorized by us in writing.

SECTION 4 - PREORDERS; BACKORDERS; SPECIAL FULFILLMENT ITEMS

Certain products may be offered as preorders, backorders, or otherwise as items with delayed fulfillment. Such items will be identified on the product page and/or at checkout.

By purchasing such an item, you acknowledge and agree that:

  1. Payment is collected at the time the order is placed unless otherwise stated.

  2. Any shipping, fulfillment, or release dates are estimates only and are not guaranteed.

  3. Delays may occur due to production schedules, logistics, inventory availability, carrier constraints, or other factors outside our control.

  4. We may ship orders in one or more shipments in our discretion, including shipping items together when part of an order is delayed.

Preorders and backorders may be eligible for cancellation for a refund only prior to shipment, unless otherwise stated on the product page. In limited circumstances, an order may not be eligible for cancellation once fulfillment preparation or production has begun. Shipping delays do not automatically entitle customers to a refund.

Where permitted by law, for delayed-fulfillment items, return windows are measured from delivery date, not the date the order is placed.

SECTION 5 - PRICES, TAXES, AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed and will be set out in your order confirmation.

Unless otherwise stated, posted prices do not include taxes, shipping, handling, customs, or import charges. You are responsible for applicable taxes and fees.

You agree to provide current, complete, and accurate purchase and account information and to promptly update your information as needed to complete transactions and contact you.

SECTION 6 - SHIPPING, DELIVERY, AND RISK OF LOSS

All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, weather, or events outside our control.

Once we transfer products to the carrier, title and risk of loss pass to you to the fullest extent permitted by law. You are responsible for providing an accurate shipping address. If a package is returned due to an incorrect address provided at checkout, additional shipping charges may apply.

SECTION 7 - RETURNS, REFUNDS, AND EXCHANGES

Our Refund Policy forms part of these Terms and governs returns, refunds, and exchanges.

Returns must be initiated and handled in accordance with our Refund Policy. Unauthorized returns may be refused.

Discontinue use and seek medical advice if you experience an adverse reaction.

SECTION 9 - PROMOTIONS; DISCOUNTS; GIFT CARDS

Promotions may be governed by additional terms. If there is a conflict between promotion terms and these Terms, promotion terms will govern.

Gift cards are subject to additional terms and, where permitted by law, are non-refundable and not redeemable for cash except as required by law.

Our Services, including but not limited to trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by Seazond, its affiliates, or licensors and are protected by U.S. and foreign intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. Except as expressly provided, nothing in these Terms grants you any license or rights in our intellectual property.

SECTION 11 - FEEDBACK AND USER CONTENT

If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, feedback, reviews, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback in any medium for any purpose, including commercial use.

You represent and warrant that you own or have all necessary rights to submit Feedback and that your Feedback will comply with these Terms and applicable law.

We may, but have no obligation to, monitor, edit, or remove Feedback in our discretion.

Some jurisdictions do not allow the limitation of liability for certain damages, so some of the above limitations may not apply to you.

SECTION 17 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Seazond and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims (including reasonable attorneys’ fees) arising out of your breach of these Terms, your violation of any law, or your access to or use of the Services.

We may terminate this agreement or your access to the Services (or any part thereof) in our sole discretion at any time, to the fullest extent permitted by law. You remain liable for all amounts due up to and including the date of termination.

Provisions that by their nature should survive termination will survive, including Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, and Privacy.

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforceable to the fullest extent permitted by applicable law, and the remaining provisions will remain valid and enforceable.

These Terms and any separate agreements whereby we provide Services shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to conflict of law principles.

You and Seazond consent to venue and personal jurisdiction in the state and federal courts located in Warren County, New Jersey, unless otherwise required by applicable law.

SECTION 23 - CHANGES TO TERMS

We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms by posting updates on our website. It is your responsibility to check for changes. Where required by applicable law, we will provide notice of material changes.
